Data Ownership Policy

HawkSoft received the following resources from Gaya, specifically from Section 4 of Gaya's Terms of Service.

4.1 Ownership and Provision.
You own and retain all right, title, and interest in and to information, data, content, and/or files accessed, transmitted, uploaded, or stored in association with your use of the Services ("Your Data"), including all intellectual property rights therein. You (a) are solely responsible for the accuracy, content and legality of Your Data and (b) acknowledge and agree that, unless you elect for Your Data to be hosted or stored by or on behalf of Gaya, you (not Gaya) will have sole control over hosting and storage of Your Data.

4.2 Use of Your Data.
If you elect for Your Data to be hosted or stored by or on behalf of Gaya, you hereby grant Gaya a worldwide, royalty-free, fully paid license, with the right to sublicense to applicable service providers, to collect, host, use, access, view, store, copy, display, and otherwise process Your Data to provide, support, monitor, analyze, and improve the Services.

4.3 Rights in Your Data.
You represent and warrant to Gaya that you have the rights, licenses, and permissions necessary to grant the license and use rights in Section 4.2. You acknowledge that Gaya exercises no control over the content of Your Data. You will not upload, post, reproduce, or distribute any information, software, or other material protected by copyright, privacy rights, or any other intellectual property rights without first obtaining the permission of the owner of such rights.

Without limiting the generality of the foregoing, you will be solely responsible for: (a) ensuring that you and Gaya, to the extent acting on your behalf, have the right to collect, store, use, process, and share Your Data via the Services; and (b) providing adequate notice to, and obtaining any necessary consents from, any individuals as required under Applicable Laws with respect to Your Data collected, stored, used, processed, and shared in connection with the Services.

4.4 Data Training.
Gaya will not use Your Data to train artificial intelligence or machine learning models.
